The topic, of course, is unpleasant, but useful for all military personnel. And if you, a young man, ended up in the army, then the concept of the content of chapter 33 of the Criminal Code of the Russian Federation is extremely necessary for you.
So, there is the aforementioned chapter in the Criminal Code of the Russian Federation that concerns only military personnel (and citizens equated to them, for example, undergoing military training) who commit crimes against military service, and in peacetime.
Let's start with crimes against the order of subordination and military relations between military personnel. So they brought you to your duty station, put you in a barracks, and assigned you a squad commander, for example, Sergeant Velikov. After a while, you take over, having a cropped head and a proud disposition, with a sergeant in the company's outfit. He's on duty ordering you, the day clerk, to clean out the company toilet. And you only say one word "no". But don't rush to do that. In the Criminal Code there is article 332, which explains that the failure of a subordinate to execute the order of the chief (open refusal to execute, improper fulfillment of the requirement), given in accordance with the established procedure and causing significant harm to the interests of the service,
it is a crime for which you can get 2 years of hardships and hardships in a disciplinary battalion (and then serve again in your home unit). If a group crime is committed by prior agreement or has entailed serious consequences, then it is punishable by up to 5 years ' imprisonment. But if the order is not executed due to negligence or due to an unfair attitude to the service, then criminal liability "shines" only when serious consequences occur. In this case, the guilty person can be punished either by arrest for up to 6 months, or by keeping in a disbat for up to 2 years.
For the very "cool" there is Article 333, which provides for imprisonment for up to 5 years ("gangbang", use of weapons or serious consequences "pull" from three to eight). For example, you resisted a superior officer or an official (a patrol officer or a company officer on duty), or forced these persons to violate their duties. Let's say (in practice, this should not be done in any case) I closed the duty sergeant Velikov, who was already boring everyone, in the toilet, and then, being a day clerk, I opened the rifle room, took a Kalashnikov assault rifle and shot it for fear, even at the ceiling. That's exactly what you can get for about seven to eight years of camps.
The same term (up to 8 years) is provided for in Article 334 of the Criminal Code of the Russian Federation for intentional violent actions against a superior officer committed during the performance of his military service duties or in connection with the performance of these duties.
I would like to hope that you, having read these unpleasant articles of Chapter 33 of the Criminal Code, will not want to experience their effect on yourself and will serve according to the Charter. Moreover, the Criminal Code provides for articles that will protect you in the army from "hazing" (in the Navy and in the Marine Guard of the Federal Border Service - from "godkovschiny"). Remember, article 335 of the Criminal Code of the Russian Federation provides for criminal liability for violating the statutory rules of relations between military personnel in the absence of subordination relations between them. That is, if, for example, a private (sailor) who served on the draft for a year and a half, requires you, a month ago, a completely civil intelligent boy (who graduated with honors from a music school in the violin class), to carefully wash his battered socks and at the same time gives you a long queue of light kicks, calling you various indecent words, then he, consider, is already preparing a place in the disbat or in the camp zone. In the first case, he is due up to 2 years, in the second-up to 3 years of captivity.
If a private (sailor) used violence against you, God forbid, mocked, humiliated honor and dignity, and repeatedly or with the help of colleagues, in a group by prior agreement with the use of weapons, besides causing moderate damage to your health, then we can assume that he "untwisted" for a period of time up to 5 years old. And with the onset of serious consequences, it can sit on all ten. The main thing is not to hesitate to immediately officially tell your commander (chief) in the officer rank about the actions of an ordinary "grandfather".
Just remember: in the Criminal Code of the Russian Federation there is Article 336, in which it is written in black and white that even insulting a serviceman is a crime. That is, if the above-mentioned private deliberately humiliated the honor and dignity of your person and this was expressed in an indecent form, and you immediately reported this to the officer, then the guy who does not know how to behave with dignity can be isolated from you in a disbat for up to six months.
And if, you say, the commander does not respond to complaints and covers up"non-regulation"? In this case, it makes sense to contact the military prosecutor's office. I'll tell you a secret: a very effective tool! Well, if suddenly, after your appeal to the military justice authorities, this boss decides to call you names, you can only tactfully remind him that he violates article 336 of the Criminal Code, according to which the boss for insulting a subordinate can be punished with restriction on military service (if he is an officer) or content in a disciplinary unit (if, let's say he is a sergeant and serves on conscription) for a period of up to one year. If someone does not know what a "restriction on military service" is, we will explain: this is a "sequestration" of their salary, depriving them of the chance of promotion in rank and position. But remember: insulting the boss is also fraught with a similar term.
In general, be polite, study the Criminal Code carefully, and share what you've learned with your colleagues. Those who know the laws and do not allow anyone to sit on their neck in spite of them, usually serve quietly in the army. Good service to you!
